Britney Spears Father Shuts Down Popular Fan Site

Britney Spears' father Jamie, who is in charge of Britney's conservatorship, is accusing Jordan Miller, the owner and webmaster of the popular fansite of copyright infringement, citing photographs, videos, and lyrics. Miller who owns the site thinks that Jamie is attacking the site for taking the stance that Jamie is controlling Britney's life and that she is like a prisoner. Brit's father, Jamie supposedly earns $18,000 a month for taking care of the conservatorship. Here is what Jordan, who is asking for donations for his site which operates at a deficit of $350 a month, wrote on his website:

"Dear BreatheHeavy readers,

I, Jordan Miller, Owner & Webmaster of BreatheHeavy.com and BritneyRes.com, want to thank you with all my heart for the loyalty and support you’ve shown over the last 5 years BreatheHeavy has been open.

We are all here for one purpose: to support the icon of our generation, Britney Spears, and to continuously stick by her through the good and bad.

I have been battling the conservatorship Britney is currently placed under for months now. When I did not conform to the requests and demands Britney’s management and father, Jamie Spears, recently put upon BreatheHeavy to stay quiet, they in turn became angry and malicious, launching, what I feel is an unjust attack, against me and my website.

As a result, I received a legal notice from Jamie Spears’ lawyers pressuring me to close BreatheHeavy.com by 3:00 p.m. PST today, March 27, 2009, or face an injunction, claiming they will pursue legal action by Jamie Spears, who, as a conservator, is legally allowed to act as Britney and sue using her money and lawyers.

“Britney doesn’t control her affairs,” said Brad Rose, the lawyer representing Britney in this case in a telephone conversation.

“You are an uber fan who’s gone a little too far.”

The legal notice states BreatheHeavy is not in compliance of Copyright Infringement laws, violating Britney’s rights of publicity and privacy:

'The Infringing Sites are replete with willful, unauthorized and unlawful use and/or exploitation of: (i) the copyrighted lyrics to songs written and/or recorded by Ms. Spears; (ii) Ms. Spears's trademarked name, (iii) various video and audio recordings embodying the performances of Ms. Spears; and (iv) photographic images of Ms. Spears (owned or exclusively licensed to third parties by Ms. Spears).

The unauthorized use of these recordings, images, copyrighted works and trademarks constitutes actionable infringement under, inter alia, copyright and trademark law, and also violates Ms. Spears's rights of publicity and privacy."

"Ms. Spears will pursue damages and injunctive relief in connection with the blatant violation of her rights of publicity and privacy.'

The real issue, in my opinion, is hidden behind these Copyright Infringement claims, rather management, particularly her father / conservator, Jamie Spears, who makes $18,000 a month off his daughter, is desperately trying to hide the truth about Britney’s imprisonment, and shut anyone up who disagrees with their conniving and selfish exploitation of an innocent mother of 2 pushed back into the lime-light just several months after a hospitalization.

Another issue the lawyers claim aside from “Copyright Infringement,” is the use Britney’s trademarked name and image, stating I am not allowed to use her name or picture except for editorial and hard news purposes only.

Additionally, the Google and TicketMaster ads placed around the website are a “major issue,” stating I am using Britney’s name and image for financial gain without her consent.

BreatheHeavy.com is a non-profitable website, meaning I, nor anyone, makes a PROFIT off the website. The ads used help the website remain self-sustainable, and if there is a profit made, the funds, in return, are used to purchase magazine scans and other materials needed for the website.

Am I crazy and naive for running a major website that leaves me in debt each month? Possibly, but BreatheHeavy is my passion, a creative outlet that has allowed me to grow as an individual.

Britney Spears is my inspiration; I can’t put a price on that.

Though I made very clear to the attorneys that BreatheHeavy is a non-profitable website, it is of no concern of theirs.

This entire site thrives because of YOU, the fans, who support Britney by buying tickets to her show, merchandise and music. Sadly, your hard-earned money that goes to supporting your favorite celebrity, is now money being used to potentially sue me, a major fan and supporter of Britney Spears, and hide fans from knowing the TRUTH.

This conservatorship Britney is placed under, which controls every aspect of her life, is now clenching the future of her biggest Fansite.

I’m prepared to fight, but I need to know that you guys are willing to fight with me.

Khloe Kardashian was scared out of her mind to pose for Peta. When they told her to drop her robe on the PETA shoot, she said she couldn't go forward with the shoot and walked away. It took sister, Kim Kardashian [a pro at showing skin especially after her Playmate shoot ] to convince Khloe to go forward with the shoot.

Khloe felt self-conscious about her body size. She said that everyone already thinks she's a "large and in charge woman" and a "transvestite." To make matters worse, her father Bruce Jenner said to her, after finding out she would be posing nude for PETA, "Don't you think you should lose a few pounds?" Khloe was also wearing black and he said, "Isn't that why you are wearing black?" Khloe responded that she wore black because she was feeling depressed.

Madonna poses for photographer Steven Klein for a "W Magazine" shoot. Her boyfriend Jesus Luz, signed to Ford Models is also on set as one of the models.

Jesus's father Luis Heitor, 46 said:

Rihanna flew out tattoo artist Bang Bang and put him up in a hotel so that he could add to her tattoo ensemble. Rihanna already has:

"Shhh" tattooed on a finger, a Maori design on her right hand and stars behind her ear (that match stars behind Brown's ear)"

I would have made the gun a little bigger. It looks like it could be a nasty birthmark right now.

Bang Bang really wanted to do the tattoos on her frontside above each armpit, but Rihanna said no:

Lindsay Lohan Will Make Your Movie Flop, DO NOT HIRE

All producers and directors should refrain from hiring 22-year-old Lindsay Lohan who cannot shake her straight to DVD complex. Just when you thought Lohan's acting career couldn't get any deeper in the trenches, her newest movie goes straight to cable TV!

Real Housewife of New York, Fired! Naked Pics?

Even "The Real Housewives of New York" are not recession proof. Alex McCord, 35, lost her visual merchandising job at Victoria Secret's New York City office. She was one of 90 positions cut.

While surprised that she lost her job, she said that it made sense in light of the economy. She feels lucky that her bills are covered by her husband Simon van Kempen. Her salary went to discretionary things like a nanny, which she will not have to cut yet until her severance pay runs out.

Gwen Stefani wants a Girl but Needs a Break

Gwen Stefani and Gavin Rossdale are parents to two sons, 2-year-old Kingston and 7-month-old Zuma. The two music stars will hold off on trying for a baby girl for now. Rossdale explains:

"Well that would seem logical, but then again, so would sleep! A bit of selfish time would be nice."

Stefani will also tour this summer with "No Doubt" after a 5 year break. The band wants to record a follow-up to 2001's "Rock Steady" album and feels that playing some shows will make time in the studio that much better. Stefani said:

"I think we should go out now. I don't think we should wait. Pack up the babies and get a bunch of nannies. So fun! Would be so inspiring to get out there and play all those songs again."

"Complex" magazine was not quite finished with their Kim Kardashian image, before placing it online. The magazine displayed a very splotchy and veiny legged Kim Kardashian. Realizing that Kim Kardashian at face value is not extraordinary, "Complex" later replaced the real image of Kim with one where here thighs were filled in with the shimmering skin from her boobies.

Lance Armstrong Breaks Collarbone

37 year-old Armstrong [who looks like he's going on to 55 years-old] was on the first leg of a five day race in Spain on Monday, when he fell and broke his right collarbone. He wrote on twitter:

"I'm alive! Broken clavicle (right). Hurts like hell for now. Surgery in a couple of days. Thanks for all the well wishes."

The seven-time Tour de France champion said:

"I'm miserable, I just need to relax a couple of days and then make a plan."

Whitney Port, Heartbroken: "The City" Finale Blog

Whitney Port and Australian boyfriend, Jay Lyon call it quits. Port and boyfriend spent a good part of the season trying to make the relationship work. While she still had very strong feelings for Jay, she felt it was necessary to say goodbye. Whitney did not want to devote more time or patience on figuring out the details of their relationship, especially at the sacrifice of her career goals. It was really sad to watch her have to reject Jay and while I think that some of the show is scripted, I think that Whitney developed real feelings for Jay.:

"Hi all... I hope everyone enjoyed the season finale of The City last night. Throughout this whole experience I have watched this show as somewhat of a home video -- more like a fun way to relive the past. But last night's episode was not this way.

Kitson is a favorite stop for celebrities to shop in Los Angeles. Many celebrities have also unveiled their clothing lines and other products here. Ritchie's jewelry line called "House of Harlow," is named after her firstborn daughter, Harlow. Ritchie, who's personal style seems to have turned 70's free-spirit [sporting a thin forehead band is a favorite]. This earthy direction seems to be rubbing off on her jewelry line.

Russell Brand Naked in Australia

33 year-old comedian and self-professed sex-addict stood naked in full frontal view on a balcony in Australia. Brand looked like he was filming "Forgetting Sarah Marshall 2." His character from the movie does not seem to fall too far from his real personality--a quirky existentialist, lady's man:

Michelle Pfeiffer's New Movie: Sex with Grandma

In Michelle's Pfeiffer's new movie "Cheri," Pfeiffer plays a 50 year-old seductress to a 27 year-old Rupert Friend:

"It is turn of the century in Belle Epoque Paris and a scandalous romp is underfoot. The sensational tale begins as the ravishing Lea (Michelle Pfeiffer) contemplates retirement from her renowned stature as Paris's most envied seductress to the rich and famous. The movie is rated R for the multiple sex scenes. I think it would be to generous to even call Pfeiffer a cougar.

Lady Gaga wants to be the pimple to pop music like Amy Winehouse was the flu to pop music. Confused? Lady Gaga admires Amy Winehouse, and she does not want to be associated with the "normal" pop stars but wants to be offbeat:
